    DENZA Christchurch ("DENZA Christchurch", "we", "us" or "our") is an authorised DENZA dealership in New Zealand. We recognise the importance of your privacy and appreciate that your personal information is very important to you. We are committed to protecting your privacy and complying with our obligations under the New Zealand Privacy Act 2020 and the 13 Information Privacy Principles (IPPs). This commitment extends to the handling of all personal information collected in or from New Zealand. Where applicable, DENZA Christchurch will handle personal information in accordance with any specific exemptions provided under the New Zealand Privacy Act 2020 or other relevant New Zealand legislation. In this Privacy Policy "personal information" has the meaning set out in the Privacy Act. Basically, personal information is information or an opinion about an individual who is reasonably identifiable. This Privacy Policy outlines:

    • the kinds of information we collect and hold about you;
    • how you can deal with us anonymously;
    • the kinds of sensitive information we collect;
    • how we collect your personal information;
    • the purpose by which and how we collect, use and disclose your personal information;

    As an authorised DENZA dealership, DENZA Christchurch operates independently. This Privacy Policy applies only to DENZA Christchurch and the personal information we collect. If you interact directly with DENZA New Zealand or another authorised DENZA dealership, their respective privacy policies will apply. This Privacy Policy applies to customers, potential customers, suppliers, service providers, agents, contractors, secondees, potential employees, temporary staff and generally does not apply in relation to our current or former employees.

    1. THE COLLECTION OF PERSONAL INFORMATION

    1.1 Information we collect and hold

    We collect information that is reasonably necessary for, or directly related to one or more of our functions and activities. The types of personal information we collect include but are not limited to your:

    • gender;
    • age and birth date;
    • occupation and employment details;
    • contact details;
    • residential and/or business address, including postcode;
    • registration and driver's licence details;
    • other forms of identification used to confirm your identity;

    • other financial information;
    • current and past vehicle information and details;
    • cookies, website tracking and usage information including but not limited to Device ID, User/Cookie ID or Cookie Identifier;
    • location through anti-theft vehicle tracking technology in loan and demonstrator vehicles;
    • voice when we record inbound and outbound calls for quality, training and record purposes;
    • image by videos and photos at events, during market research or through security cameras;
    • educational qualifications, resume and reference checks;
    • personal interests; and
    • personal preferences (such as your preferred vehicle specifications).
    Anonymity

    Where appropriate, we provide you with the option of remaining anonymous when entering into transactions with us, unless such anonymity would be considered unlawful or impracticable. If you elect not to provide us with your personal information, we may not be able to do business with you or consider you for recruitment opportunities.

    Sensitive Information

    Generally, we do not collect sensitive information. However, we may collect sensitive information about you (for example, health information and criminal record checks if you are applying for a job with us), if we have your express consent or if the collection is required or authorised by law.

    1.2 How we collect your personal information

    We take steps to ensure that we collect personal information by lawful means, and obtain your personal information in various ways, including but not limited to: We collect your personal information in the following circumstances and for the stated purposes:

    • When you contact us: When you contact or correspond with us, we collect information to respond to your enquiry and provide customer support.
    • Customer support: When you phone or email us, we collect information to provide assistance, maintain service records, and improve our services.
    • Visiting our premises: When you attend our dealership or service centre, we collect information for security, health and safety, and to manage your visit.
    • Dealership and vehicle services: When you visit our dealership to test drive, purchase, finance or service a vehicle, we collect information to facilitate those services, process transactions and maintain your vehicle records.
    Important Notice on Location Tracking

    Vehicles you test drive or loan from us may be fitted with anti-theft tracking technology. This technology may track the vehicle's location during your loan period for asset protection, recovery and safety purposes.

    • Purchases: If you order or purchase a product or service from us, we collect information to process your order, provide the product or service, and manage our commercial relationship.
    • Roadside assistance: From third-party roadside assistance providers where necessary to facilitate assistance you have requested.
    • Digital interactions via our website: - information you submit through enquiry forms or account creation; - cookies and similar technologies; - information necessary to provide website functionality.
    Public Posting Warning

    Any information you post publicly on our website or social media may be visible to others.

    • Social media interactions.
    • Marketing, competitions, promotions, events, surveys and market research.
    • Publicly available sources where lawful.
    • Third-party service providers where appropriate.
    • Employment applications.
    • DENZA New Zealand where necessary to facilitate vehicle ordering, warranty administration, technical support, recalls or related manufacturer services.
    • Government or regulatory authorities where required or authorised by law.

    Where you provide personal information about another individual, we rely on you to inform them that you are providing their information to us and to make them aware of this Privacy Policy.

    2. PURPOSE OF COLLECTION, USE AND DISCLOSURE OF PERSONAL INFORMATION

    2.1 How we use personal information

    Primarily we collect personal information for the purpose declared at the point of collection so we can provide you with the best possible experience and comply with our legal, regulatory and business requirements. More specific purposes include but are not limited to:

    • any purpose which we inform you about when we collect your personal information or to which you have provided your consent;
    • buying, selling, servicing, repairing and loaning vehicles and parts;
    • registering your interest in purchasing vehicles, servicing vehicles or purchasing parts;
    • arranging finance, insurance or related products where requested;
    • any related purpose reasonably necessary for our dealership functions or activities;
    • customer management, responding to enquiries and communicating with you about products and services;
    • providing customer support and assistance;
    • fulfilling and processing orders and administering accounts;
    • roadside assistance, warranty administration, product issues, service measures and recalls;
    • marketing, events, competitions and promotional activities;
    • informing you of special events or offers;
    • reporting, customer surveys, customer analysis, market research and product development;
    • accounting, billing and internal administration;
    • servicing and maintaining IT systems;
    • recruitment purposes;
    • protecting our legitimate interests;
    • complying with legal and regulatory requirements; and
    • where permitted or required by law, a court or tribunal.

    2.2 Disclosure

    During the course of our day-to-day business we may disclose your personal information to third parties outside our organisation, including but not limited to: • parties you have authorised; • DENZA New Zealand where reasonably necessary to facilitate vehicle ordering, warranty administration, technical support, recalls or other manufacturer-related services; • our contracted service providers including payment providers, marketing agencies, website technology providers, financiers, insurers, mailing houses, printers, organisations assisting with promotions, market research, analytics, recruitment, debt collection, roadside assistance, cloud hosting, IT service providers, auditors and professional advisers; • third-party consultants engaged under obligations of confidentiality; • government agencies, regulators, law enforcement authorities or other entities where required or authorised by law.

    2.3 Our Commitment to Children's Privacy

    We do not knowingly collect, use, share or sell the personal information of children. If we become aware that we have collected personal information from a child contrary to law, we will take reasonable steps to delete that information.

    2.4 Cross border disclosure

    In the ordinary course of business, some of our service providers may transfer, access, process or store personal information outside New Zealand. Where this occurs, we take reasonable steps to ensure overseas recipients protect personal information in accordance with the Privacy Act 2020 unless an exception under that Act applies. Overseas organisations may also be required to disclose information under the laws of their own jurisdictions. To the fullest extent permitted by law, we are not responsible for disclosures required under those foreign laws.

    2.5 Direct marketing

    Direct marketing involves communicating with you directly to promote our products and services using channels such as mail, telephone, email, SMS or other electronic messaging. Where required by law, we will obtain your consent before using or disclosing your personal information for direct marketing purposes. We do not knowingly market to children without appropriate parental consent.

    2.5.1 Electronic communications

    Where we communicate with you electronically for marketing purposes, we comply with the Unsolicited Electronic Messages Act 2007. Commercial electronic messages will: • only be sent with the required consent; • accurately identify us and provide contact details; and • include a functional unsubscribe facility.

    2.5.2 Unsolicited Electronic Messages Act 2007

    If you have asked us not to contact you for telemarketing purposes, or your number is registered on the applicable New Zealand Do Not Call register, we will not contact you for telemarketing purposes. We may still contact you regarding matters that are not considered telemarketing, including product recalls, appointments, payments, contracts or communications you have requested.

    2.5.3 Opting out - Direct marketing, electronic communications and telephone calls

    You may opt out of receiving direct marketing communications at any time. If you opt out, we will stop sending marketing material until you tell us otherwise. You can opt out by contacting us using the contact details published on our website or by contacting our Privacy Officer.

    2.6 Cookies, Tracking and Retargeting Technologies

    We use cookies, tracking technologies and similar technologies to make our website more user-friendly, improve its performance and display content and advertising that may be more relevant to you. Where certain technologies are used, identifiers stored in cookies may be associated with information we already hold about you where you have consented to such use. For technologies that require consent under applicable law, we will only use them where you have provided that consent.

    2.6.2 Managing preferences

    You can manage your cookie preferences through our website, browser settings or your device settings. If you choose to opt out of certain cookies, you may need to repeat that process if you change browsers or devices.

    2.6.3 Data transmission outside of New Zealand

    Use of certain web technologies may result in information being processed or stored outside New Zealand.

    3. SECURITY OF PERSONAL INFORMATION

    3.1 Integrity and quality of personal information

    We take reasonable care to ensure that personal information we use, store and subsequently destroy or delete (where relevant) meets appropriate quality requirements, including that the information is accurate, up to date and complete.

    3.2 Security of personal information

    While care is taken to protect your personal information, unfortunately no data transmission over the internet can be guaranteed to be 100% secure. Accordingly, we cannot guarantee the security of information you send to us or receive from us online. This is particularly true for information transmitted by email before it reaches our systems. Once we receive your personal information, we will protect it in accordance with the Privacy Act 2020. We continually train and remind our staff of the importance of keeping personal information safe and secure. We have adopted security measures designed to protect your personal information from misuse, interference, loss, unauthorised access, disclosure and modification, including:

    1. System security: Our systems are password protected and accessible only by authorised personnel. Where appropriate, confidential information is encrypted. Security measures include firewalls, malware protection, monitoring and other industry-standard security controls.
    2. Physical security: Our premises are protected against unauthorised access through measures such as access controls, alarms, CCTV and other appropriate security systems.
    3. Data retention: If personal information is no longer required for the purpose for which it was collected or retained, and we are not required by law to retain it, we will take reasonable steps to securely destroy, de-identify or delete it. We retain information only for as long as required by law or our legitimate business purposes.

    Whilst we seek to keep your personal information secure, errors or security incidents may occur from time to time. Where appropriate, we will investigate such incidents and implement reasonable measures to reduce the likelihood of recurrence. We will not sell, rent or trade your personal information to unrelated third parties.

    4. ACCESS, CORRECTION, COMPLAINTS AND ENQUIRIES

    We take reasonable steps to ensure that information we collect, hold or disclose about you is accurate, complete and up to date.

    4.1 Access to information we hold about you

    At any time, you may request access to personal information we hold about you. We aim to respond to requests within the timeframes required by the Privacy Act 2020. Where permitted by law, we may charge a reasonable fee for providing access. Where an exception under the Privacy Act applies, we may refuse access or provide access in an alternative manner where reasonable. If access is refused, we will provide reasons where required by law.

    4.2 Correction of information we hold about you

    We encourage you to let us know if your personal information changes or requires correction. We will take reasonable steps to update or correct your information in accordance with the Privacy Act 2020.

    4.3 Complaints and enquiries

    If you are not satisfied with the way we have handled your personal information or believe we have breached the Privacy Act 2020 or the Information Privacy Principles, please contact us. We will endeavour to investigate and resolve your complaint promptly. For security reasons, complaints, access requests, correction requests and privacy enquiries should be made in writing.

    5. INFORMATION RELATING TO PROSPECTIVE, CURRENT AND FORMER EMPLOYEES

    This Privacy Policy generally does not apply to current or former employees. However, we recognise that employee records should be handled with appropriate care and in accordance with applicable laws. This Privacy Policy does apply to independent contractors, job applicants, secondees and work experience students. Employees with questions relating to employee records should contact DENZA Christchurch's management or human resources representative.

    6. CHANGES TO THIS PRIVACY POLICY AND OBTAINING A COPY OF THIS POLICY

    We make this Privacy Policy available on our website and will provide a copy free of charge on request. We reserve the right to amend this Privacy Policy at our discretion and at any time. If changes materially affect your rights or the way we use your personal information, we will provide notice where required by law. When changes are made, we will publish the updated Privacy Policy on our website and update the 'Last Updated' date. Each version of this Privacy Policy will be identified by its Last Updated date.
